There are three key HOA-related pieces of legislation to track that are coursing through St. Paul.  See the bills and links below.

We’re tracking the CAI responses to this, and I’ve summarized their opinions below.

Concerns with SF 1750

CAI-MN opposes SF 1750 in its current form. While they would consider supporting the bill if specific amendments are adopted, the current version imposes restrictive fee limits, increases administrative burdens, and creates duplicative dispute resolution procedures. These issues would lead to unintended consequences—specifically, increased costs at a time when rising insurance premiums are already making homeownership more difficult, weakened funding for maintenance of communities and a lack of volunteers willing to serve on their boards. CAI would consider supporting if the following changes are made, removing limitations on fees, restricting contracting authority, lengthy dispute resolution process, and additional administrative requirements. CAI-MN supports HF 3808/SF 4035 (see below).

Key SF1750 problems include:

• Higher costs and inefficiency from limits on fees and contracting, eliminating bulk purchasing and long-term agreements

• Increased delinquencies and underfunded budgets, leading to deferred maintenance and declining property values

• More litigation and insurance costs, diverting money from community upkeep

• An overbroad, one-size-fits-all approach that punishes well-functioning communities

A Better Solution: HF 3808 (Myers-R; Norris-D)/SF 4035 (Frentz-D; Kreun-R)

HF 3808/SF 4035 is a bipartisan bill that provides balanced, targeted reform to protect homeowners without driving up costs or destabilizing communities. It:

• Preserves self-governance while improving transparency

• Requires buyers to acknowledge receipt of key disclosures before purchase

• Mandates disclosure of reserve studies and insurance information

• Requires clear, transparent policies for violations, fines, and collections (including certified notice before legal action)

• Clarifies association authority to responsibly manage budgets, maintenance, and operations
